Overtime Lawyers and Overtime Attorneys

Unpaid Overtime, Unpaid Meals or Breaks, and Working off the Clock are violations of Overtime Law

Overtime Law

Overtime attorneys know how hard you work and are dedicated to making sure that you get paid for the hours you've put in. While some employers may not realize that they have to pay overtime wages to their employees, others willfully choose to disregard the law and refuse to pay overtime. If you were denied overtime pay, you may be able to recover double your unpaid overtime wages.

Overtime lawyers file claims on behalf of employees who have been wrongfully deprived of fair pay for every hour they worked. You did the work, now let our attorneys help you collect the unpaid overtime pay that you earned. There are time limits that apply to overtime claims, so it is important to act promptly in order to ensure that your rights are protected.

The Fair Labor and Standards Act (FLSA), a federal law, establishes overtime standards for employees. According to the FLSA, non-exempt employees should receive time-and-a-half pay for hours worked over 40 in one workweek. Unfortunately, every year thousands of employees fall victim to FLSA violations. In 2003 alone, over $200 million was recovered in back wages because of overtime violations.

If you are working over 40 hours in a workweek without additional pay contact us for a free overtime consultation.

Employee Classifications

Overtime law states that non-exempt employees should be compensated for hours worked over 40. Exempt employees are ineligible to receive overtime pay. These workers fall under the executive exemption; administrative exemption; professional exemption; outside sales exemption; or computer employee exemption. However, misclassifying employees into one of these categories is a common overtime scam employers use to avoid paying overtime.

If you believe you have been misclassified as exempt, or want to find out if you are considered an exempt or nonexempt employee we can help. Contact us to find out your classification for free.

Job duties, not job titles, determine who is exempt and non-exempt from Overtime. It is important to remember that salaried employees can be entitled to overtime pay. They are not automatically exempt simply because they are paid by salary. If you have not been paid overtime and you are a non-exempt employee, an overtime attorney can help you file an overtime lawsuit.
