Employee Issue - The Hiring Process

Disabilities

The Americans with Disabilities Act has strict guidelines about what can and cannot be done during the hiring process. Many employers may be confused how to hire a person who can perform the job, without violating the law. It is important to remember in an interview that you can ask about a person’s abilities, but not about their disabilities. You can inquire how to the applicant can perform job tasks, but you cannot ask whether they have disabilities that can prevent them from job functions. You may also ask if the applicant, whether a disability is apparent or not, if they will need any special accommodations to perform the job.
